ASSUMPTION OF RISKS
I am aware that participating in the sport of Ice Hockey / Shinny has many inherent risks, including but not limited to:
GENERAL:
- theft, vandalism or loss of personal property;
- any manner of injury resulting from use, misuse, non-use and failure of any equipment;
ICE HOCKEY/ SHINNY:
- all manner of injury arising from falling and impacting against the floor or ice surface, walls or rink boards, or apparatus/equipment;
- impacting with other participants, referees, or equipment which includes, but is not limited to, game equipment such as skates, pucks, sticks, helmets, goals, etc.;
- abrasions, bruises, blisters or cuts resulting from activities or impact with other participants or equipment;
- an increased load on the heart, which may result in dizziness, shortness of breath and in extreme circumstances, may result in a heart attack;
- potential for bone and muscular skeletal injury, such as sprains and strains;
- episodes of light headedness, fainting, chest discomfort, leg cramps and nausea;
- travel to and from the arena.
I freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death, property damage or loss, resulting therefrom.
RULES AND REGULATIONS
In consideration of Calgary Adult Hockey League allowing my participation in the sport of Ice Hockey / Shinny, I agree as follows:
1. TO ABIDE BY ALL CALGARY ADULT HOCKEY LEAGUE RULES AND REGULATIONS which are posted and updated on the Calgary Adult Hockey League CAHL.ca Web site.
2. TO ABIDE BY ALL CALGARY ADULT HOCKEY LEAGUE RULES AND REGULATIONS SUCH AS, HOWEVER NOT LIMITED TO, RULE 4j. (version of rule 4j. as of Oct 27, 2006) Any player or team that is involved in any way with any conduct which is deemed inappropriate at the sole discretion of the officials before, during, or after a game, on or off arena property may receive a suspension at the sole discretion of the officials. A one game, multi-game, season, multi-season, or permanent suspension may result for any player or team at the sole discretion of the officials. No refunds will be issued. A one (1) game or minimum suspension may not be appealed.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
In consideration of Calgary Adult Hockey League allowing my participation in the sport of Ice Hockey / Shinny, I agree as follows:
1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against Calgary Adult Hockey League, and its members, officers, employees, students, agents, volunteers and independent contractors (all of whom are hereinafter collectively referred to as "the Releasees");
2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my participation in the sport of Ice Hockey / Shinny due to any cause whatsoever INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS' LIABILITY ACT, RSA 1980 c. 0-3 AS AMENDED ON THE PART OF THE RELEASEES;
3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from my participation in the sport of Ice Hockey / Shinny; and
4. THAT if I am supplying my own equipment, I am responsible for ensuring that it is safe and well maintained equipment which is up to the requisite standards for the activity in which I am participating. I understand that Calgary Adult Hockey League accepts no responsibility for any incidents or accidents occurring out of the use or misuse of my equipment.
5. This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity. In entering into this Agreement, I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this Agreement.
I HAVE READ AND UNDERSTOOD THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.
